Terms and Conditions

1. Definitions

• Hovenier.frl: The platform managed by Hovenier.frl, registered in the Netherlands
• User: Any natural or legal person who uses our services
• Service Provider: Gardeners affiliated with our platform
• Platform: The website and associated services of Hovenier.frl

2. Applicability

These terms and conditions apply to all services offered by Hovenier.frl and to all agreements between Hovenier.frl and users of the platform.

By using our website and services, you agree to these terms.

3. Our Services

3.1 Platform services

Hovenier.frl offers an online platform where customers can find gardeners and get in touch for quotes and services. We facilitate the connection between customers and service providers.

3.2 No contracting party

Hovenier.frl is not a party to the agreements between customers and gardeners. All arrangements, prices, and conditions are agreed upon directly between the customer and gardener.

4. Use of the Platform

4.1 Permitted use

• The platform may only be used for finding gardeners
• All information provided must be accurate and complete
• You may not act in violation of the law or public morals

4.2 Prohibited use

• Sending spam or unsolicited messages
• Using automated systems without permission
• Providing false or misleading information
• Activities that may disrupt the operation of the platform

5. Registration and Account

5.1 For Customers

Customers can use the basic functionalities of the platform without registration.

5.2 For Gardeners

Gardeners who wish to join the platform go through a screening process in which certificates, insurance, and references are verified.

6. Intellectual Property

All content on the platform, including texts, images, logos, and software, is the property of Hovenier.frl or its licensors. It is not permitted to copy or distribute content without permission.

7. Liability

7.1 Limited liability

Hovenier.frl is only liable for direct damage that is demonstrably and exclusively the result of an attributable failure in the performance of the agreement.

7.2 Excluded liability

Hovenier.frl is not liable for:

• The quality of services provided by affiliated gardeners
• Indirect damage, consequential damage, or business losses
• Damage from offered quotes or performed work
• Technical malfunctions or downtime of the platform

8. Costs and Payments

8.1 For Customers

The use of the platform is free of charge for customers. All costs for work performed are handled directly between the customer and the gardener.

8.2 For Gardeners

Gardeners do not pay any fees for participation on the platform. No commissions are charged on obtained assignments.

9. Complaints and Disputes

9.1 Complaints procedure

Complaints about our services can be submitted via [email protected]. We aim to handle all complaints within 14 days.

9.2 Disputes between users

Disputes between customers and gardeners are resolved by the parties themselves. Hovenier.frl may mediate but is not obligated to do so.

10. Termination

Hovenier.frl reserves the right to refuse or terminate access to the platform in case of violation of these terms or misuse of the platform.

Users can terminate their account at any time by contacting our customer service.

11. Changes

Hovenier.frl may amend these terms and conditions at any time. Changes will be announced on the website and take effect 30 days after publication.

In case of significant changes, users will be notified via email (if applicable).

12. Applicable Law

These terms and conditions and all agreements with Hovenier.frl are governed by Dutch law. Disputes will be submitted to the competent court in the Netherlands.

These terms have been drawn up in Dutch. In case of differences between translations, the Dutch text shall prevail.
